Terms & Conditions

These Terms & Conditions explain the terms that apply when you use the Clarté Soul website and book or use our listening and emotional support services.

By making a booking with Clarté Soul, you confirm that you have read and understood these Terms & Conditions and agree to be bound by them.

1. About Clarté Soul

Clarté Soul provides a professional listening and emotional support service.

Our service provides a private and compassionate space for individuals to talk, express themselves and feel heard.

Clarté Soul is not a medical, psychiatric, counselling, psychotherapy or emergency service.

Our listeners do not provide medical diagnoses, medical treatment or professional mental-health treatment.

If you require medical or professional mental-health support, you should contact an appropriately qualified healthcare or mental-health professional.

2. Eligibility

By making a booking, you confirm that:

  • The information you provide is accurate and belongs to you.
  • You are legally able to enter into an agreement for the service in your country.
  • You will use the service respectfully and appropriately.
  • You understand the nature and limitations of the Clarté Soul service.

Unless otherwise stated on the booking page, Clarté Soul services are intended for adults aged 18 and over.

3. Booking a Call

Bookings are made through the Clarté Soul website.

When making a booking, you will be asked to provide information such as your name, contact details and preferred appointment time.

You are responsible for ensuring that the information you provide is accurate.

Your booking is confirmed once payment has been successfully received and you have received a booking confirmation.

Available appointment times are subject to availability.

4. Prices and Payment

The price of each service will be displayed before you complete your booking.

Payment must be made through the payment method available on the website.

All applicable prices will be clearly displayed at the time of booking.

Clarté Soul reserves the right to change its prices for future bookings. Any price change will not affect a booking that has already been confirmed.

5. Call Duration

Your call will last for the duration selected when making your booking.

For example, a 30-minute booking provides up to 30 minutes of listening time.

Please ensure that you are available at the agreed appointment time.

If you arrive late, the call may still need to finish at the originally scheduled end time.

6. Cancellation and Changes

We understand that circumstances can change.

If you need to cancel or change your booking, please contact us as soon as possible.

Any cancellation or refund will be handled in accordance with our Cancellation & Refund Policy and applicable consumer law.

Nothing in these Terms & Conditions is intended to remove or restrict any legal rights you may have as a consumer.

Where applicable, consumers booking services online may have statutory cancellation rights. The application of those rights can depend on circumstances, including when the service is due to begin and whether the customer has requested that the service starts during the cancellation period.

7. Missed Appointments

If you do not attend your scheduled call and have not contacted us beforehand, the booking may be treated as a missed appointment.

Any refund or rescheduling will be subject to our Cancellation & Refund Policy and applicable consumer rights.

If technical problems prevent the call from taking place, please contact us so that we can consider the appropriate solution.

8. Respectful Use of the Service

Clarté Soul is intended to provide a respectful and supportive environment.

You must not:

  • Threaten, abuse or harass a listener.
  • Use offensive or discriminatory language towards a listener.
  • Make unwanted sexual or inappropriate comments.
  • Attempt to obtain a listener’s private or personal information.
  • Record, reproduce or distribute a call without appropriate permission.
  • Use the service for unlawful purposes.
  • Deliberately provide false information in order to misuse the service.

Where inappropriate or abusive behaviour occurs, Clarté Soul may end a call or refuse future bookings where reasonably necessary.

9. Confidentiality

We understand that you may discuss personal matters during your call and we treat information shared with us with care.

However, confidentiality cannot be guaranteed in every circumstance.

There may be situations where information needs to be disclosed where we are legally required to do so or where there is a serious safeguarding concern involving an immediate or significant risk of harm to you or another person.

Our approach to personal information is explained in our Privacy Policy and Safeguarding Policy.

10. Safeguarding and Emergencies

Clarté Soul is not an emergency or crisis service.

If you or another person is in immediate danger, please contact the appropriate emergency service in your country.

If, during a call, information is disclosed that creates a serious safeguarding concern, Clarté Soul may take reasonable steps to protect the safety of the person concerned.

This may include ending the call, contacting emergency services or sharing relevant information where legally permitted or required.

We will seek to act proportionately and responsibly in such circumstances.

11. No Medical or Therapeutic Advice

Clarté Soul does not provide medical, psychological or psychiatric diagnosis or treatment.

Listeners are not providing a substitute for a doctor, therapist, counsellor, psychologist, psychiatrist or other qualified healthcare professional.

Nothing discussed during a Clarté Soul call should be relied upon as medical or professional advice.

12. Privacy and Personal Information

We collect and use personal information in accordance with our Privacy Policy.

You should read our Privacy Policy before making a booking.

Because customers may choose to discuss sensitive matters during a call, Clarté Soul may receive information that is particularly sensitive in nature. We will handle personal information in accordance with applicable data protection law and our Privacy Policy.

13. Recording of Calls

Unless clearly stated otherwise and with the appropriate legal basis and consent, Clarté Soul will not intentionally record calls.

Customers must not record, reproduce, publish or distribute a call without appropriate permission.

If our recording practices change, we will update our Privacy Policy and provide any information or consent required by applicable law.

14. Website Use

You may use the Clarté Soul website for lawful and personal purposes.

You must not attempt to interfere with the operation or security of the website or use the website in a way that could damage Clarté Soul or other users.

We aim to keep the information on our website accurate and up to date, but we do not guarantee that the website will always be available or free from errors.

15. Intellectual Property

Unless otherwise stated, the content on the Clarté Soul website, including the Clarté Soul name, branding, logo, text, graphics and original materials, belongs to Clarté Soul or is used with permission.

You may not reproduce, copy, modify or commercially use our content without prior permission.

16. Limitation of Responsibility

Clarté Soul will provide its services with reasonable care and skill.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for other rights that consumers have under applicable law.

We do not guarantee that using the service will resolve a particular problem, improve a person’s circumstances or produce a particular emotional outcome.

17. Ending or Refusing a Service

Clarté Soul may end a call or refuse a future booking where reasonably necessary, including where:

  • A person behaves abusively or threatens a listener.
  • The service is being misused.
  • Continuing the call would create a serious safety concern.
  • We are unable to safely or appropriately provide the service.

Where a booking is cancelled by Clarté Soul, any refund will be considered in accordance with applicable law and our Cancellation & Refund Policy.

18. Complaints

We want every client to have a respectful and positive experience.

If you have a concern or complaint about our service, please contact us through the contact details provided on our website.

We will review your complaint fairly and aim to respond within a reasonable period.

19. Changes to These Terms

We may update these Terms & Conditions from time to time.

The current version will be published on the Clarté Soul website with the date it was last updated.

Changes will not retrospectively alter the terms of a booking that has already been confirmed unless required by law.

20. Applicable Law

These Terms & Conditions are governed by the laws of England and Wales, unless applicable consumer protection laws in your country provide otherwise.

If you are an international customer, you may have mandatory consumer rights under the laws of the country where you live. Nothing in these Terms & Conditions is intended to remove or restrict those rights where the law does not allow us to do so.

21. Contact

If you have any questions about these Terms & Conditions, please contact Clarté Soul through the contact details provided on our website.
